Terms and Conditions

ORDER ACCEPTANCE

While we do every thing possible to meet delivery requirements, orders can only be accepted subject to delays caused by strikes, deliveries from our suppliers, and/or any other conditions beyond our control. Possession of this price list does not obligate Priority One Flooring to sell any of its products to anyone.

PRICE

Prices, terms and conditions are those in effect at the time of shipment and are subject to change without notice.

TAXES

Goods and Services Tax appear as a separate item. Provincial Sales Tax is extra where applicable.

FREIGHT

All shipments are F.O.B. our warehouse unless otherwise indicated.

RETURNED GOODS

Returned goods will not be accepted without prior consent, and will not be accepted after 15 days of delivery. Please call our order desk to obtain a return number. A minimum 15% restocking charge will be assessed on all accepted returns. Returned material must be prepaid, in full original cartons, in saleable conditions, and accompanied by an original numbered invoice. No returns will be accepted on non-stocked, special order or discontinued items. No returns on setting materials.

PRODUCT CLAIMS

Variations of size, colour and shading are inherent of all ceramic and natural stone products. No claims with respect to size, colour and/or suitability will be made after installation. The purchaser is responsible for the inspection and the acceptance of material prior to installation. It is also his responsibility to determine whether any product is suited for any particular installation or purpose. We recommend that our customers determine carefully whether installation conditions and procedures are suitable in any given case as we will not be responsible for chipping, cracking, crazing, shading or loosening from the setting bed, etc.

No claims will be accepted for damaged material after it has left our warehouse. If, for any reason, our products are regarded as unsatisfactory, we must be notified prior to installation. Installation is acceptance. Please view your material prior to installation.

FREIGHT CLAIMS

Delivery to the carrier shall constitute delivery to buyer regardless of F.O.B. point or whether freight is prepaid, collect or allowed. Claims for merchandise lost, damaged or delayed in transit must be made against the freight carrier by the customer. All claims for shortages must be reported within ten (10) days after receipt of shipment.

In no event shall this company be liable for consequential or incidental damages of any kind no matter what the cause.

EXCLUSION

These terms and conditions constitute the sole and entire agreement between Priority One Flooring and the buyer. Priority One Flooring. shall not be bound by any other conditions, or written, expressed or implied; other than those contained herein.

IT IS RECOMMENDED THAT ALL TILE PRODUCTS AND RELATED MATERIALS BE INSTALLED AS PER TTMAC STANDARDS.
